Terms of Service

GENERAL PROVISIONS

1.1. These Terms of Service ("Terms") govern the use of the TOUCHME platform ("Platform", "Service"), including all modules, tools, features, and digital services provided through its website and mobile applications.

1.2. TOUCHME is a digital platform that enables Users to browse and publish listings, access dating and social features, communicate with others, view or offer digital content (TouchMe FANS), and use paid promotional services.

1.3. By accessing or using the Platform, the User agrees to comply with these Terms.

1.4. The Platform is strictly intended for individuals aged 18 or older.

1.5. TOUCHME may update these Terms at any time. Continued use of the Platform after changes means acceptance of the updated Terms.

1.6. TOUCHME does NOT operate as:

• an escort agency,
• a prostitution service,
• a matchmaking intermediary,
• an employer or manager of Users,
• a provider of offline services.

The Platform is a neutral hosting provider that offers tools for Users to publish and access digital content.

1.7. TOUCHME does not mediate, arrange, supervise, promote, or control any offline meetings, activities, or transactions between Users.

DEFINITIONS

"Platform" / "Service" – the TOUCHME digital environment including website, app and modules.

"User" – an individual aged 18+ who has registered an Account.

"Guest" – an individual browsing the Platform without registering.

"Account" – a profile created by the User.

"Content" – photos, videos, posts, descriptions, messages and any digital material uploaded by Users.

"Listing" – any advertisement or post published in the marketplace section.

"Creator" – a User publishing paid content within TouchMe FANS.

"Premium Services" – paid tools including boosts, promotions, subscriptions, and additional visibility options.

"Moderator" – automated systems or staff reviewing compliance with the Terms.

"TouchMe FANS" – subscription-based digital content module.

ACCOUNT CREATION AND USER ACCESS

3.1. Users must be 18 years old or older to register.

3.2. Users must:

• provide accurate information where required,
• secure their login credentials,
• refrain from granting minors access to the Platform,
• comply with local laws when using the Platform,
• refrain from impersonation or fraudulent activity.

3.3. TOUCHME may:

• suspend or remove Accounts violating these Terms,
• request identity verification (including government ID),
• restrict access if fraud, abuse or illegal conduct is suspected.

3.4. Users may delete their Account at any time. Deleting an Account does not grant refunds for any paid services.

3.5. TOUCHME does not guarantee the identity, background, authenticity or intentions of any User. Users interact at their own risk.

USER RESPONSIBILITY FOR LEGAL COMPLIANCE

4.1. Users are solely responsible for ensuring that:

• their use of the Platform is legal in their country,
• their services, listings or content comply with local laws,
• their offline interactions comply with the regulations of their jurisdiction.

4.2. TOUCHME does not provide legal advice and does not guarantee that the Platform's use is lawful in every country.

PLATFORM FEATURES

The Platform provides:

• marketplace listings,
• dating and swipe features,
• profile browsing (grid, map, swipe),
• direct messaging (free or paid),
• likes, ratings and comments,
• access to TouchMe FANS creators,
• paid boosts and premium visibility tools,
• location-based search and filters.

PROHIBITED CONTENT AND BEHAVIOR

The following is strictly prohibited:

6.1. Illegal content of any kind.

6.2. Content involving minors (persons under 18), including:

• nudity,
• sexualized content,
• suggestions, descriptions or implications involving minors.

6.3. Child Sexual Abuse Material (CSAM) – ZERO TOLERANCE.

6.4. Explicit offers of sexual services, including:

• prostitution,
• escort services,
• paid sexual acts,
• price lists for sexual activities.

6.5. Violence, hate speech, harassment or threats.

6.6. Scams, fraud, extortion, or attempts to obtain money illegally.

6.7. Stalking, blackmail or intimidation.

6.8. Content violating copyrights or personal rights.

6.9. Uploading images or videos of other people without their consent.

6.10. Using the Platform to arrange, promote, or advertise illegal activities.

Violation may result in:

• immediate account termination,
• removal of content,
• reporting to law enforcement.

MARKETPLACE LISTINGS

7.1. Listings may include:

• massages,
• wellness and lifestyle services,
• companionship (non-sexual),
• dating and meetups,
• creative services (photo/video),
• legal, non-sexual personal services.

7.2. Listings must:

• be legal in the User's country,
• not imply sexual services,
• not mislead or defraud Users.

7.3. TOUCHME may remove or moderate listings as needed.

TOUCHME FANS – PAID DIGITAL CONTENT

8.1. Creators may publish paid content accessible via:

• subscriptions,
• pay-per-view,
• tips.

8.2. Creators:

• must be 18+,
• must verify their identity for payouts if required,
• set their own prices,
• comply with law and these Terms,
• earn revenue minus Platform commission.

8.3. TOUCHME may:

• withhold payouts in case of fraud or chargebacks,
• remove illegal or non-compliant content,
• suspend Creator Accounts for violations.

PAYMENTS, SUBSCRIPTIONS AND REFUNDS

9.1. Supported payment methods may include:

• credit/debit cards,
• online payments (Stripe),
• BLIK (where available),
• cryptocurrency (if enabled).

9.2. Subscriptions renew automatically unless cancelled.

9.3. Digital content purchases are NON-REFUNDABLE unless required by law.

9.4. Chargebacks may result in account suspension and withheld payouts.

9.5. Users are responsible for their tax obligations.

10. LIABILITY DISCLAIMER

10.1. TOUCHME is not responsible for:

• the behavior, actions or content of Users,
• the identity of Users,
• damages resulting from meetings or offline interactions,
• loss of data, revenue or opportunities,
• technical interruptions, bugs or downtime.

10.2. The Platform is provided "as is" without guarantees.

10.3. Users interact with others at their own risk.

11. COOPERATION WITH LAW ENFORCEMENT

11.1. TOUCHME maintains ZERO TOLERANCE for:

• human trafficking,
• exploitation,
• child abuse,
• forced activities.

11.2. When required by applicable law, the Platform may cooperate with authorized agencies investigating serious crimes.

11.3. Reports involving minors or human trafficking may be escalated without requiring a court order.

12. PRIVACY AND PERSONAL DATA

12.1. User data is processed in accordance with the Platform's Privacy Policy.

12.2. Users may request:

• access to their data,
• correction,
• deletion (when legally possible),
• restriction of processing.

12.3. Some data may be retained to comply with legal or security obligations.

13. REPORTING VIOLATIONS

13.1. Users may report:

• illegal content,
• harassment,
• impersonation,
• copyright violations,
• threats or security concerns.

13.2. TOUCHME may:

• temporarily hide content,
• suspend Accounts,
• conduct internal review,
• contact authorities when required.

14. ACCOUNT TERMINATION

14.1. Users may delete their Accounts at any time.

14.2. Account deletion results in:

• loss of access to all features,
• cancellation of active subscriptions without refund,
• possible retention of data required by law.

15. FINAL PROVISIONS

15.1. These Terms take effect upon publication.

15.2. In matters not covered by these Terms, applicable law of the User's jurisdiction applies.

15.3. In case of conflict between language versions, the English version prevails unless stated otherwise.
