TouchMe Fans – Terms & Conditions

These TouchMe Fans Terms ("Fans Terms") apply to the subscription-based content module within TouchMe ("TouchMe Fans"). They complement the main TouchMe Terms & Conditions and apply specifically to creators and subscribers using the Fans module.

1. Role of the Platform

TouchMe provides tools for creators ("Creators") to upload content and receive payments from subscribers ("Subscribers").

• TouchMe is not an employer, agent or manager of Creators.
• All content is created and published solely by Creators under their own responsibility.

2. Eligibility

• Creators and Subscribers must be at least 18 years old.
• Creators may be required to verify their identity and age via ID verification.

3. Creator Obligations

Creators agree to:

• Upload only content they own and have rights to.
• Ensure all appearances in their content are consenting adults (18+).
• Comply with all prohibitions under the main Terms (no minors, trafficking, non-consensual content, etc.).
• Set their own subscription prices and manage their offers.
• Pay any taxes due in their jurisdiction on income generated through the Platform.

Forbidden for Creators:

• Using Fans as a cover for illegal prostitution or trafficking.
• Selling access to illegal content (CSAM, non-consensual scenes, hate content, etc.).
• Encouraging illegal acts or self-harm.

4. Subscriber Obligations

Subscribers agree to:

• Use purchased content for personal viewing only.
• Not record, download, re-upload, redistribute, or sell creator content outside the Platform without permission.
• Not harass Creators or pressure them into illegal or uncomfortable activities.

Violation may result in account suspension and possible legal consequences.

5. Ownership and License

• Creators retain ownership of their content.
• By uploading, Creators grant TouchMe a limited, non-exclusive license to host and display the content on the Fans module.
• Subscribers obtain a limited, personal, non-transferable right to view content they have paid for, subject to these Terms.

6. Payments and Revenue Share

• Creators receive a portion of the revenue from subscriptions, tips, or sales.
• TouchMe may retain up to 30% as a platform fee (subject to change with notice).
• Payouts may be subject to minimum thresholds and processing times.
• TouchMe may withhold payouts in case of investigations into fraud, illegal content, or chargebacks.

7. Refunds

• Payments to Creators via Fans are non-refundable, unless required by law or due to proven technical error.
• Refunds, if any, are at TouchMe's discretion.

8. Moderation and Enforcement

• TouchMe may remove content that violates any Policy.
• Creators who repeatedly violate rules may be banned from Fans or the entire Platform.
• Serious violations (e.g. minors, CSAM, trafficking) may be reported to law enforcement.

9. Termination

• Creators can stop using Fans at any time and may request to close their Fans account.
• Subscribers can cancel subscriptions at any time; access will continue until the end of the paid period.
• TouchMe may suspend or terminate any Fans account for violations or high-risk behavior.
